A good source of mine has heard that the BA/AA antitrust ruling won’t be coming this week… and in fact, he says it is not likely until well into December or even January (with the caveat that it is basically informed speculation). The problem, of course, is continuing disagreement between DOT and DOJ over the transatlantic link-up. There was some hope from the airlines involved that a ruling might come around Thanksgiving, and apparently regulators had given them some indication of that. But since the nominal deadline for a decision passed at the end of December, the urgency appears to have slipped away.I don’t think that American or British Airways minds the extra time too much, but the underlying reasons would be more worrying to them. Obviously, DOJ has concerns about DOT’s thinking on the airlines’ joint venture. If I had to guess, I would say DOT wants to approve with few carveouts, but DOJ wants the carriers to pay a steeper price.
