    Once again Michael Denis of InfoTrust has started an interesting discussion by asking the simply question, “what is the definition of airworthy?” in the LinkedIn Aviation Service Lifecycle Management group.

     

    Sure, there’s FAA’s definition of an airworthy aircraft found in FAA Order 8130, but as Michael points out, U.S. case law has a couple of options. As one attorney who commented in this discussion says, “Truth be told, the responsibility for determining ‘airworthiness’ falls (depending on the circumstances) upon manufacturers, owners, operators, repair stations, and pilots alike.”
